OFFICE MEMORANDUM

Sub:- Action against Government servants who get appointment on the basis of false SC/ST/OBC certificates.

The undersigned is directed to invite reference to this Department’s OM No.11012/7/91-Estt.(A) dated 19.5.1993 which provides as under:-

"Wherever it is found that a Government servant, who was not qualified or eligible in terms of the recruitment rules etc., for initial recruitment in service or had furnished false information or produced a false certificate in order to secure appointment, he should not be retained in service. If, he is probationer or a temporary Government servant, he should be discharged or his services should be terminated. If he has become a permanent Government servant, an inquiry as prescribed in Rule 14 of CCS (CCA) Rules, 1965 may be held and if the charges are proved, the Government servant should be removed or dismissed from service. In no circumstances should any penalty be imposed".

The CIC Prof M Sridhar Acharyulu held on 3rd November 2014 that ‘charge-sheet’ has to be disclosed after separating non-disclosable portions, if any, as per restrictions prescribed under RTI Act. Ms. Usha Kanth Asiwal sought to know from Director of Vigilance Delhi, details of complaint made to Anti Corruption Bureau on 25-04-2001 and  inquiry leading to registration of case against 13 persons under Prevention of Corruption Act, which is now under prosecution in Tis Hazari Courts. She sought 22 point information, which broadly relate to contents of the Charge-sheet.

Attention is invited to this Office OM No. CPAO/Tech/Pre-2006/Revision/2011-12/191 dated 23rd October, 2012 circulating therewith a copy of CPAO’s’ advertisement in English released in the leading national and regional dailies on 21st October, 2012 regarding obtaining of life certificate in the revised format by the authorized banks from the Central Civil pensioner/ family pensioner in November every year.

WHEN MARRIED SON IS ELIGIBLE FOR COMPASSIONATE APPOINTMENT, WHY NOT A MARRIED DAUGHTER, ASKS MADRAS HC

Ruling in favour of a complainant, Justice D Hariparanthaman said there cannot be any discrimination between a married son and a married daughter.

CHENNAI: Why is it that a married daughter of a deceased government employee is not eligible for appointment under compassionate grounds while a married son is eligible, Madras high court has wondered. 

Ruling in favour of a complainant on Thursday, Justice D Hariparanthaman said: "There cannot be any discrimination between a married son and a married daughter.... Making discrimination between a son and a daughter on the ground of marriage is arbitrary and violative of fundamental right to equality." 

The matter relates to a writ petition filed by P R Renuka, stating that her father, an office assistant working in the animal husbandry department, died while he was in service in February 1998. He left behind his wife and three married daughters, besides an unmarried daughter.

TO PROTEST AGAINST THE NEGATIVE ATTITUDE OF THE GOVERNMENT TOWARDS POSTAL EMPLOYEES INCLUDING GRAMIN DAK SEWAKS AND CASUAL LABOURERS

December 4^th is nearing. Massive preparation are going on in every circle of the country. We are receiving very encouraging reports from circles. Kerala Circle which is far away from Delhi (Up & Down Six days train journey) has already booked ticket for 600 comrades. Total expenditure for Kerala Circle alone will come to Rs. 24,00,000/- (Rs. Twenty Four Lakhs). From Tamilnadu Circle also more than 400 comrades have already booked their tickets. Highest number of employees will participate from nearby circles of Delhi i.e. Uttar Pradesh, Rajasthan, Punjab, Haryana, Himachal Pradesh, Bihar, Uttarakhand etc. All other circles are also trying their best to mobilize maximum number of employees in the March.

Please ensure that number of employees as per the Quota fixed by the CHQ of each affiliated union participate in the historic parliament march WITHOUT FAIL. Please rise up to occasion. Wake up and act as responsible leaders of NFPE.
