THE PAYMENT OF BONUS (AMENDMENT) ACT, 2015

NO. 6 OF 2016   [31st December, 2015.]

            An Act further to amend the Payment of Bonus Act, 1965.

BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:—

1. (1) This Act may be called the Payment of Bonus (Amendment) Act, 2015.

(2) It shall be deemed to have come into force on the 1st day of April, 2014.

2. In section 2 of the Payment of Bonus Act, 1965 (hereinafter referred to as the principal Act), in clause (13), for the words ‘‘ten thousand rupees’’, the words ‘‘twenty-one thousand rupees’’ shall be substituted.

3. In section 12 of the principal Act,—

(i) for the words ‘‘three thousand and five hundred rupees’’ at both the places where they occur, the words ‘‘seven thousand rupees or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher’’ shall respectively be substituted;

(ii) the following Explanation shall be inserted at the end, namely:—

‘Explanation.—For the purposes of this section, the expression ‘‘scheduled employment’’ shall have the same meaning as assigned to it in clause (g) of section 2 of the Minimum Wages Act, 1948.’

4. In section 38 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

‘‘(1) The Central Government may, subject to the condition of previous publication, by notification in the Official Gazette, make rules to carry out the provisions of this Act.’’.

Government has set up a one-man committee to examine the wage structure and service conditions of Gramin Dak Sevaks (GDS)

Dear Comrades,

The Government has set up a one-man committee to examine the wage structure and service conditions of Gramin Dak Sevaks (GDS) in the Department of Posts.

An official press release said Mr. Kamlesh Chandra, retired Member of Postal Services Board, would constitute the committee. 

The committee will be assisted by Mr. T.Q. Mohammad, a Senior Administrative Grade Officer, who will act as Secretary to the GDS Committee. 

The committee will go into the service conditions of Gramin Dak Sevaks and suggest changes as considered necessary. 

Gramin Dak Sevaks are extra-departmental agents recruited by the postal department to serve in rural areas. They have been for a long time demanding pay and facilities on par with regular employees of the department.

The terms of reference of the committee will, inter-alia, include the following:-

a) To examine the system of Branch Post Offices, engagement conditions and the existing structure of wage and enrolments paid to the Gramin Dak Sevaks and recommend necessary changes;

b) To review the existing Services Discharge Benefits Scheme/other social security benefits for the Gramin Dak Sevaks and suggest necessary changes;

c) To review the existing facilities/welfare measures provided to the Gramin Dak Sevaks and suggest necessary changes;

d) To examine and suggest any changes in the method of engagement, minimum qualification for engagement as Gramin Dak Sevaks and their conduct and disciplinary rules, particularly keeping in view the proposed induction of technology in the Rural Post Offices.

The Department of Post has 2.6 lakh Gramin Dak Sevaks, all of whom will come under the purview of GDS Committee, the release added.

Good news for Class-III, IV govt job seekers: No interviews from Friday

As per Modi, the decision will "free the youth from corruption".

"From tomorrow, interviews for government jobs in Class-III and Class-IV categories will be abolished," Modi had tweeted on Thursday about the decision which will impact over 29 lakh central government posts. "This will help curb corruption," he had said.

Modi's tweet came soon after he talked about the issue at an event in Noida while laying the foundation stone of a 14-lane expressway connecting Delhi with Meerut.

Modi had first talked about his intent to abolish interviews for lower level government jobs in his last Independence Day address, saying the practice breeds corruption and many poor people lose out in the process.

Ricoh India to digitize 130,000 rural Post Offices in India

Ricoh India today said it will digitize 130,000 rural Post Offices in India.

As part of the deal, Ricoh India will install and maintain services of hardware, peripheral devices and operating system for Department of Posts.

Ricoh India is partnering with Department of Post for implementing and operating integrated rural hardware solution for around 1,30,000 post offices across India. Ricoh solution includes hand held devices with camera, bio metric facility, solar panels at EDO level and network connectivity.

In order to ensure smooth functioning of the devices, Ricoh will also set up services centers across India.

These mobile terminals will facilitate all postal and financial transactions in the rural branch offices, and upload this data to India Post data center to improve the delivery and quality of services in the rural areas.

Ningthounai village gets post office as New Year gift from India Post

IMPHAL, December 30: Manipur Postal Department has presented advance New Year 2016 gift to Ningthounai, Yairipok in Thoubal by opening a new Branch Post Office at the village.

According to a release issued by Manipur Postal Division, Vinod Kumar Director (Posts) Manipur inaugurated the newly built post office by cutting ribbon during which he congratulated the villagers as their village has got connected with more than 1,54,000 post offices of India post which is the world largest network of post offices.

Mustofa Ahamed will be the Branch Postmaster of the new office and Md. Ruhid will work as Mail Carrier-cum-Mail Delivery. Kumar expressed happiness on the occasion of bringing a Post Office closer to the people of the area and said that people can book Speed Post letters and parcels from the office instead of going to Yairipok Sub Post Office or Imphal Head Post Office which is far away. Announcing that all social security schemes will be publicised through this post office, the Director appealed to the members of the public to insure their lives of sum assured of Rs. 2 lakhs with Pradhan Mantri Suraksha Bima Yojana by subscribing with just Rs 1 per month.

Confederation writes to NJCA for Strike

Dear Comrade,

Kindly refer to your circular letter of 21^st December, 2015 wherein you have reiterated the decisions taken at the meeting of the NJCA on 8^th December, 2015.  We have already  advised our affiliates to carry out the programmes slated for 30^th December, 2015 and 19 to 21^st January, 2016.  The employees have realized that the report of the 7^th CPC is  the worst  ever in the history of wage revision of the Central Govt. employees.  They have also realized that a show down is inevitable to  change the situation. 

We feel in the given situation, it is the bounden duty of NJCA to provide leadership, unite the employees and lead the struggle, which alone can bring about tangible improvements. Though for the Confederation and its affiliates, strike ballot is not mandatory, we shall go through the process for it will enable our State and District level leaders to explain the various retrograde recommendations of the 7^th CPC to the rank and file of the membership.

We, however, feel that the strike ballot, if taken say by the end of January, will help us to create a salutary impact at the time of discussions.  We also feel that the Government might hold consultation with us only once at the level of the Cabinet Secretary.  Besides, As per the decision  of the meeting of NJCA of 8^th December, 2015, we are to  conclude the negotiation with the Government by the first week of February so that we would be able to declare the date of strike in the slated meeting of the NJCA on  8^th Feb. 2015.  In the circumstance, we suggest that the decision for the strike ballot may be taken immediately and the same is concluded by the end of January, 2016 i.e., before the declaration of the date of commencement of indefinite strike. You may kindly hold discussions with the NJCA members over the phone and if agreed upon take appropriate decision to hold the strike ballot by the end of January, 2016.

We make this request for it may pose some difficulties for us to go in for the strike ballot later than January. 2016.
