Invite to India from DDG PosTech

Dear Comrades,

At a recent conference, India Post gave a presentation that covered a few facts about the company in the light of its involvement with PosTech 2011.

Alka Jha, DDG PosTech, has invited the “entire global postal family” to PosTech 2011, to held in New Delhi on March 14-16. India Post’s Jha made the invite as she delivered a key-note presentation at the World Mail & Express Conference earlier this year.

Her slideshow outlined the technological advancement being undertaken in the Asian country, as well as outlining the company’s aspirations for PosTech 2011. Jha said that PosTech will benefit from the significant growth in Indian postal market, which is already tech-friendly and only improving. There will be a vast scope of interest, and “the entire global postal family should be there”, she said.

It was announced that India Post – the largest postal network in the world – is poised to become a modern, computerised postal network – with more than 12,000 post offices already networked.
They also revealed that there is a large focus on the development of in-house software, giving the SpeedNet software as an example. The Post also plans to further innovate via its Centre of Postal Technology Excellence, it was revealed.

India Post: low-cost distribution and establishment of multiple agencies

Dear Comrades,

Under Indian insurance rules and regulations, only licensed insurance agents or intermediaries can receive commission or remuneration for the solicitation and procurement of insurance business in India. Corporate agents are recognised as legitimate insurance distribution channels that are bound by the rules and regulations applicable to insurance agents. To operate validly as a corporate agent, the entity must be licensed to act for an insurer under the delegated authority of the Insurance Regulatory and Development Authority (IRDA) under the IRDA (Licensing of Corporate Agents) Regulations 2002 and the Guidelines on Licensing of Corporate Agents of July 14 2005.

A corporate agent is licensed to represent one life insurer, one general insurer or one of each. No corporate agent can represent more than one life insurer or one general insurer.

For several years the industry has lobbied the IRDA to approve a multiple agency system. In September 2007 the IRDA even set up a committee to consider, among other things, multiple agencies for banks, although thus far no general permission has been granted by the IRDA.

However, on September 13 2010 the IRDA took a concrete step in the right direction when it released an exposure draft in which it proposed to accord special status to the Department of Posts (more commonly referred to as 'India Post') and allow it to create corporate agency tie-ups with more than one insurer.

On October 18 2010 the IRDA established the framework for granting special corporate agency status to India Post under Sections 14(1) and 14(2)(c) of the IRDA Act 1999. It provided that, except for the exemptions provided under the framework, the Insurance Act 1938 and the regulations and guidelines applicable to corporate agents thereunder shall also apply to India Post. The key features of the framework are as follows:

For the purpose of registration as a corporate agent, each 'postal circle' of India Post will be considered as a separate person and be able to hold separate independent corporate agency licences. Each postal circle will be allowed to hold corporate agency licences with up to two general insurers, two life insurers, one agricultural insurer and one standalone health insurer.

All employees of India Post who have basic high-school qualifications will be considered eligible to distribute insurance. India Post will take steps to train these employees within one year of the regulations entering into force.

All postal circles and the head office will be barred from selling or sharing their customer database with any insurer. India Post's head office will be barred from obtaining a corporate agency licence or engaging in the distribution of insurance in any other way. Only the postal circles under the head office will be eligible to become corporate agents.

Although this move by the IRDA is primarily aimed at providing a low-cost distribution platform and increasing the penetration of insurance in semi-urban and rural areas, it is also a significant step towards establishing multiple agency tie-ups for the distribution of insurance in India.

Lok Sabha on Tuesday cleared the Bill to rename Orissa as `Odisha' and its language as `Odiya' instead of Oriya

Dear Comrades,

NEW DELHI: The Lok Sabha on Tuesday cleared the Bill to rename Orissa as `Odisha' and its language as `Odiya' instead of Oriya.

The Orissa (Alteration of Name) Bill was piloted by home minister P Chidambaram in the House. Adoption of the Bill by the Rajya Sabha is likely to be a mere formality.

A number of states and cities have shed their more anglicised names adopted during the colonial rule to revert to their original forms. Among similar rechristened cities and states are Mumbai (Bombay), Chennai (Madras), Kolkata (Calcutta) and Karnataka (Mysore). Uttarakhand, born as Uttaranchal, later adopted its present name.

Protection of Women against Sexual Harassment at Workplace Bill, 2010

Dear Comrades,

The Union Cabinet today approved the introduction of the Protection of Women against Sexual Harassment at Workplace Bill, 2010 in the Parliament to ensure a safe environment for women at work places, both in public and private sectors whether organised or unorganized. The measure will help in achieving gender empowerment and equality.

The proposed Bill, if enacted, will ensure that women are protected against sexual harassment at all the work places, be it in public or private. This will contribute to realisation of their right to gender equality, life and liberty and equality in working conditions everywhere. The sense of security at the workplace will improve women's participation in work, resulting in their economic empowerment and inclusive growth.

Salient features of the Bill are as follows:
• The Bill proposes a definition of sexual harassment, which is as laid down by the Hon'ble Supreme Court in Vishaka v. State of Rajasthan (1997). Additionally it recognises the promise or threat to a woman's employment prospects or creation of hostile work environment as 'sexual harassment' at workplace and expressly seeks to prohibit such acts.

• The Bill provides protection not only to women who are employed but also to any woman who enters the workplace as a client, customer, apprentice, and daily wageworker or in ad-hoc capacity. Students, research scholars in colleges/university and patients in hospitals have also been covered. Further, the Bill seeks to cover workplaces in the unorganised sectors.

• The Bill provides for an effective complaints and redressal mechanism. Under the proposed Bill, every employer is required to constitute an Internal Complaints Committee. Since a large number of the establishments (41.2 million out of 41.83 million as per Economic Census, 2005) in our country have less than 10 workers for whom it may not be feasible to set up an Internal Complaints Committee (ICC), the Bill provides for setting up of Local Complaints Committee (LCC) to be constituted by the designated District Officer at the district or sub-district levels, depending upon the need. This twin mechanism would ensure that women in any workplace, irrespective of its size or nature, have access to a redressal mechanism. The LCCs will enquire into the complaints of sexual harassment and recommend action to the employer or District Officer.

• Employers who fail to comply with the provisions of the proposed Bill will be punishable with a fine which may extend to Rs.50,000.

• Since there is a possibility that during the pendency of the enquiry the woman may be subject to threat and aggression, she has been given the option to seek interim relief in the form of transfer either of her own or the respondent or seek leave from work.

• The Complaint Committees are required to complete the enquiry within 90 days and a period of 60 days has been given to the employer/District Officer for implementation of the recommendations of the Committee.

• The Bill provides for safeguards in case of false or malicious complaint of sexual harassment. However, mere inability to substantiate the complaint or provide adequate proof would not make the complainant liable for punishment.

Implementation of the Bill will be the responsibility of the Central Government in case of its own undertakings/establishments and of the State Governments in respect of every workplace established, owned, controlled or wholly or substantially financed by it as well as of private sector establishments falling within their territory. Besides, the State and Central Governments will oversee implementation as the proposed Bill casts a duty on the Employers to include a Report on the number of cases filed and disposed of in their Annual Report. Organizations, which do not prepare Annual Reports, would forward this information to the District Officer.

Through this implementation mechanism, every employer has the primary duty to implement the provisions of law within his/her establishment while the State and Central Governments have been made responsible for overseeing and ensuring overall implementation of the law. The Governments will also be responsible for maintaining data on the implementation of the Law. In this manner, the proposed Bill will create an elaborate system of reporting and checks and balances, which will result in effective implementation of the Law.

Gold Coin Sales Boom For India's Post Office

Dear Comrades,

India's Postal Service has sold more than a half-tonne of gold coins in the last two years, a sign the yellow metal is gaining acceptance as a form of investment in the world's biggest gold-consuming nation.

India is traditionally a buyer of gold jewellery -- a common gift during religious events and weddings -- but consumers are becoming increasingly aware of the benefits of holding gold in other forms like coins, bars, and via exchange traded funds.

The sale of gold coins via the post office began in October 2008, and the coins are now available in 700 post offices throughout the country, the Ministry of Communications and Telecommunications said.

"India Post is overwhelmed by the response received from the public," the ministry said in a statement released on Thursday.

The World Gold Council (WGC) expects 2010 imports to breach the 800 tonne-mark, surpassing the record 770 tonnes of imports seen in 2007.

Gold is a regulated sector in India and the federal government has allowed 23 state and private banks to trade in bullion at the wholesale and retail levels. Banks, jewellers and post offices also sell coins and bars through their retail outlets.
